1. Scope and purpose

These terms of use govern the use of the Netstream TV App (hereinafter referred to as "App") on all platforms supported by Netstream , unless the use is via a Netstream partner.

The provider of the app is Netstream AG, Richtistrasse 2, 8304 Wallisellen (hereinafter referred to as «Netstream»).

The app is provided as an access point under these terms of use, particularly for potential partners and selected users. It is not intended for use with a partner's customers.

By creating an account or using the app, the user (hereinafter referred to as "user") accepts these terms of use.

In addition, the currently applicable General Terms and Conditions (AG) of Netstreamapply. In case of conflict, these Terms of Use for this access shall prevail.

2. Access and Account

Access is granted exclusively by Netstream , in particular uponagvia theagform, by email tonetstreamor within the framework of individual agreements.

The account is personal and may not be shared with third parties. Sharing login details and allowing other individuals to use the account isagunless expressly authorized in writing by Netstream .

Netstream may require user identification and reject an accessag without giving a reason.

The user must keep their login details safe. In case of loss of login details or suspicion of unauthorized use of the account, they must inform Netstream immediately.

3. Scope of Services

The scope of services depends on the package provided for the respective access. It includes, in particular, the available TV lineup as well as any additional functions such as replay and recording, insofar as this is permitted under licensing law for the respective channels and content.

Netstream determines the scope of services for each access and may adjust, restrict, deactivate, or limit it at any time. There is no entitlement to a specific scope of services.

4. Geographical use

The use of the app under this access is limited to Switzerland and the Principality of Liechtenstein.

Netstream employs technical measures, in particular determining location based on IP address, to ensure compliance with geographical restrictions. Users must not circumvent or attempt to circumvent these measures, especially not by using VPNs, proxies, Smart DNS, or similar technologies.

If the user uses technical means to circumvent geographical restrictions despite the prohibition, he is liable for all resulting claims by rights holders or third parties against Netstream, insofar as he is responsible for this use.

5. Recording, downloading and sharing of content

The user may only record and download content using the functions integrated into the app, provided these are available for the respective broadcaster and content.

Recordings and downloads are intended solely for the user's private use. It isagto reproduce content using means other than those provided in the app or to make it accessible outside of personal use.

The transfer of content, recordings or streams to third parties, public screenings, for example in bars, hotels or event venues, as well as any form of commercial use areagunless individually agreed in writing with Netstream .

The use of the app within this access framework is solely for the internal evaluation of the Netstream TV platform by potential partners and selected users. Productive use with end customers based on this access is not permitted.

6. Availability, quality and maintenance

Access is provided free of charge and without any guarantee of availability. There is no entitlement to a specific level of availability, image or sound quality, or uninterrupted operation at all times.

The internet connection required for using the app, as well as any data volume costs, are the responsibility of the user.

Netstream may interrupt or restrict the service at any time for maintenance, updates, adjustments or for technical reasons without prior notice to the user.

Netstream provides app updates and may require users to have the latest version. Older versions may have limited functionality or may no longer be supported.

To the extent permitted by law, Netstream excludes any liability for interruptions, delays, quality defects or other impairments of the service within the scope of this access, except in cases of intent or gross negligence.

7. Data protection

Netstream processes personal data as part of this access. The data processed, the purposes for which it is processed, the recipients, and the rights of data subjects are governed by the privacy policy for the Netstream TV app. This policy is available within the app.

8. Support and Communication

Netstream does not offer guaranteed support for this access.agcan be sent tonetstream; processing will be carried out without any guaranteed response or resolution times.

Netstream can inform users via email about technical changes, maintenance work, security-related issues, or important adjustments to the app.

9. Duration of access

Netstream determines the duration of access and may limit it to a specific time period. The applicable duration in each individual case will be communicated to the user when access is granted.

The user can request termination of their access and deletion of their account at any time. A message tonetstreamis sufficient.

Once access expires, the account, including any recordings and settings, will be deleted. The user is responsible for documenting any relevant information before the account expires.

10. Blocking and Termination

Netstream is entitled to block or terminate access, in whole or in part, at any time and without giving reasons, in particular in the following cases:

• Suspected misuse or violation of these terms of use
• Suspected circumvention of geographical restrictions or security measures
• Infringement of third-party rights or licensing requirements
• security-related incidents

The user has no claims against Netstreamarising from the blocking or termination of access.

11. Third-party providers and third-party content

The content available in the app is provided by various rights holders, broadcasters, and content providers. Their license and terms of use may contain additional restrictions, particularly regarding replay, recording, advertising, or redistribution.

Netstream is obligated to comply with these requirements and to enforce them technically andagwithin the app. The user agrees to respect these restrictions.

Netstream uses third parties to provide its service. The parties that process personal data within this context are listed in the privacy policy for the Netstream TV app.

12. Rights to the app

Netstream grants the user a non-exclusive, nonag, and non-sublicensable right to use the app for the purposes set out in these Terms of Use for the duration of their access. All rights to the app, the platform, and the associated content remain with Netstream or the respective rights holders.

It isagto decompile, disassemble or otherwise reverse engineer the app in whole or in part, unless permitted by mandatory law.

13. Permissible Use and Misuse

The use of the app within this access is permitted exclusively for internal evaluation and testing purposes, in particular for assessing a possible collaboration with Netstream as a partner.

The following are specifically prohibited:

• Use towards end customers in productive operations based on this access
• Resale or transfer of access for consideration
• Manipulation of technical protection measures, in particular DRM, geoblocking and rate limiting
• automated access, such as scraping or systematic recording of large amounts of data
• any use that violates applicable law or the stipulations of rights holders

The user is liable for all damages caused by misuse, disclosure of access data or unauthorized use, insofar as he is responsible for these.

14. Confidentiality and Feedback

The user shall treat all non-public information made available to them through this access as confidential. This includes, in particular, the scope of services, functions, quality and performance characteristics of the platform, and terms and conditions. Disclosing such information to third parties and publishing it, including screenshots and recordings of the app, isagwithout the prior written consent of Netstream . This obligation continues even after termination of access.

If the user provides Netstream with feedback, suggestions or proposals for improvement regarding the app or the platform, Netstream may use these without restriction and without compensation.

15. Liability

Since this access is provided free of charge, Netstreamexcludes liability for slight negligence to the extent permitted by law. Liability for intent and gross negligence, as well as for personal injury under mandatory law, remains unaffected.

Netstream is not liable for indirect damages, consequential damages, lost profits, data loss or damages resulting from loss of use, to the extent permitted by law.

To the extent that Netstream 's liability cannot be excluded, it is limited in amount to the typically foreseeable damage.

The user is fully liable for damages resulting from violations of these terms of use, unlawful use of the content or circumvention of technical protection measures, insofar as he is responsible for these, and shall indemnify Netstream against corresponding claims by third parties.

16. Changes to the Terms of Use

Netstream may amend these terms of use at any time, particularly in the event of changes to legal or technical requirements or license terms of rights holders.

Users will be informed of any significant changes in an appropriate manner. Continued use of the app after the changes take effect constitutes acceptance of the amended terms of use.

17. Availability of the Terms of Use

The current version of these terms of use can be accessed in the app.

18. Applicable Law and Jurisdiction

These terms of use and any disputes arising from or in connection with the use of the app are governed exclusively by Swiss law.

The exclusive place of jurisdiction is the registered office of Netstream.
